  1. The Foreign Correspondent show on the ABC this evening made a couple of good points about the trials of the Bali bombers.

    (i) The Americans are putting huge pressure on the Indonesians to convict Bashir and others but in terms of adhering to legal principles the Indonesian open trials are a considerable improvement over proceedings at Guantanomo.

    (ii) While the Indonesian system remains prone to corruption it is struggling to improve itself and the recent American pressure may not be assisting. Following the recent Indonesian legal principle of non-retrospectivity of laws need not offer freedom to the bombers. They can be simply charged with murder and arson. And the claim was that this is now being done.

  2. Too right, Harry. The development of an impartial independant judiciary and strong commitment to the rule of law in Indonesia is vastly more important for Indonesia – and for us – than getting convictions in cases of Australian and/or US interest. The time for criticism is when the Indonesian legal system fails, not when it fails to convict the people we want incarcerated.
